These Terms of Service ("Terms") form a legal agreement between you and Votian Labs ("Votian Labs," "INKA," "we," "us," or "our"). By creating an INKA account or using any part of the Service, you agree to these Terms. If you don't agree, don't use the Service. Questions? Email support@inka.app.
INKA is a creator-marketing intelligence platform. It uses AI to analyse your social media content, predict how it's likely to perform, suggest improvements, surface trends, and build a private memory ("Twin") so predictions get sharper for you over time. INKA outputs are suggestions and predictions, not guarantees — real-world performance depends on many factors outside our control.
You must be at least 18 years old, have legal capacity to enter a binding contract, and not be barred from using the Service under applicable law. INKA is not intended for anyone under 18.
You're responsible for keeping your password secure and for all activity under your account. One account per person. You can pause or delete your account at any time from Settings → Account → Manage Account. Deleting permanently removes your personal data within 30 days; anonymised learnings already derived remain part of INKA (they no longer identify you). We recommend pausing instead if you just need a break.
INKA is offered in tiers (Free, Premium/Pro, Industry/Expert) with different limits and features, shown in-app. We also offer credit top-ups for additional usage.
How you pay: on our website, via Stripe; on iOS, via Apple in-app purchase; on Android, via Google Play Billing. We never see or store your card details.
Auto-renewal: subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before renewal.
Cancel or pause anytime: cancelling stops future renewals — you keep access until the end of the current paid period. Pausing temporarily stops billing while preserving your plan. Manage this in-app, or via your App Store / Play Store settings on mobile.
Refunds: we don't refund partial periods except where required by consumer law (e.g. EU 14-day cooling-off). iOS refunds are handled by Apple; Android by Google.
Price changes: we'll give you at least 30 days' notice and you can cancel before they apply.
You agree NOT to use INKA to: submit illegal, harmful, defamatory, or infringing content; submit content you don't have rights to; reverse-engineer or scrape the Service; access other users' accounts or data; circumvent tier limits or abuse free trials; use INKA for spam or fraud; resell INKA's outputs as your own AI service; use INKA's outputs to train competing AI models; or interfere with the Service's operation.
INKA is a creator-marketing tool for social platforms. The following is permitted:

All uploaded images are automatically scanned. Violating uploads are blocked and retained for safety review. Severe or repeated violations result in account termination and may be reported to relevant authorities, including the National Center for Missing & Exploited Children for child sexual abuse material, as required by law.
You own the content you submit. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to store, process, and analyse it to provide the Service to you, and to derive anonymised, aggregated patterns that improve INKA's collective intelligence. This licence ends when you delete your content, except for anonymised derived patterns (which can no longer identify you) and backups (retained up to 30 days).
We will never display your raw content publicly, sell it, or use it to train external public AI models. You're responsible for ensuring you have the rights to all content you submit.
INKA's predictions, suggestions, and optimised content are AI-generated and may not always be accurate. They are tools, not guarantees, and do not constitute financial, legal, medical, or professional advice. You are solely responsible for any content you publish, including content created with help from INKA's suggestions.
INKA also generates simulated audience comments to predict virality. These are AI-generated by simulated personas — not real users — and may include rude, flirty, or critical reactions to reflect realistic social-media dynamics. They do not represent the opinions of any real person.
INKA offers a single-tier referral program (not multi-level marketing). Every user gets a referral code; when someone you refer becomes a paying subscriber, you earn a commission on their subscription.
Referrals must be promoted truthfully — not via spam or deceptive marketing. You may NOT make false claims about INKA or describe referral earnings as "passive income," "financial freedom," or "guaranteed earnings." Commissions are first-level only, are forfeited for fraud or refunded/charged-back subscriptions, and self-referrals are prohibited. Payouts are made when your balance reaches the minimum threshold. You're responsible for any taxes on commissions you earn.
INKA — including all software, designs, logos, and content we create — is owned by Votian Labs or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use INKA as permitted by these Terms. Your content remains yours. If you give us feedback, we may use it freely to improve INKA.
To the maximum extent permitted by law, INKA is provided "as is" without warranties of any kind. We don't warrant that the Service will be uninterrupted or error-free, or that predictions will be accurate or produce any specific outcome (viral content, follower growth, or revenue).
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is capped at the greater of what you paid us in the prior 12 months or the local-currency equivalent of a nominal amount. Nothing excludes liability that cannot be excluded by law (fraud, death or personal injury from negligence, etc.).
You can delete your account anytime. We may suspend or terminate your account for violations of these Terms or the law, or if we discontinue the Service (with reasonable notice and a refund of any unused prepaid period for non-violation terminations). Provisions that by nature should survive (IP, disclaimers, liability limits, dispute resolution) continue after termination.
Before any formal claim, please contact us at legal@inka.app to resolve the dispute informally — we respond within 14 days and work in good faith to fix issues.
Governing law and jurisdiction will be specified here once Votian Labs' registration is finalised. Nothing in these Terms affects your non-waivable statutory consumer rights in your country of residence.
iOS: If you accessed INKA through Apple's App Store, these Terms are between you and Votian Labs, not Apple. Apple has no obligation to provide support for INKA and is not responsible for any product or IP claims arising from your use. Apple is a third-party beneficiary of these Terms and can enforce them against you.
Android: If you accessed INKA through Google Play, Google has no responsibility for the Service, and your use is also governed by the Google Play Terms of Service.
We may update these Terms. For material changes, we'll notify you by email and in-app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
